Jobs suitable for reassignment of disabled persons – for employers with more than 50 workers and employees. Compulsory insurance of workers and employees about the risk of "work accident" in 2021

Dear customers,

1.1.Please be kindly reminded that in accordance with article 315 of the Labour Code, an employer with more than 50 workers and employees shall be obliged to provide annually jobs suitable for reassignment of disabled persons.

Such jobs suitable for reassignment of disabled persons shall be designated on an annual basis, but not later than by the end of January each calendar year.

A copy of the list with the jobs shall be submitted to the Occupational Health Service.

In Regulation No. RD-07-1 from 2 February 2012 on determining the jobs suitable for reassignment of disabled persons lays down requirements concerning the share of such jobs per sectors.

A relevant order shall be issued to set up a Work Capability Assessment Commission, which shall have the following composition: Chairperson: the CEO of the enterprise
Members: representatives of the workers and employees (member of the Working Conditions Committee, representative of a trade union); the safety and health at work body; a medical doctor from the Occupational Health Service.

The list with the jobs designated for reassignment is NOT TO BE SUBMITTED to the Employment Agency.

2. We remind you that annually under the provisions of the Ordinance on compulsory insurance of workers and employees about the risk "work accident" and Order № RD-01-61 of 22.10.2020 г., which has a coefficient of occupational injuries by economic activities for applying in 2021

Only companies belonging to the economic activity, with labor accidents equal to or higher than the national average are obliged to be insured "work accident" for people in the main and supporting activities.

It does not mean that all employees in the company must be insured. Eligible employees insurance are determined by order and for this purpose it is necessary to have a protocol ordinated with the Committee / Group of working conditions and service occupational health service.

Average coefficient of occupational injuries for 2021 for the country KTT = 0,62.
